Everything stated in these Terms of Use in the singular also refers to the plural and vice versa.

No provision of these Terms shall be deemed as derogating from any other provision of these Terms.

The headings in these Terms are for convenience only.

Within the framework of these Terms:

• “Site User”, or “User”, or “You” — any person and/or corporation and/or any entity, that makes any type of use of the Site, which includes, among other things, viewing, or browsing, or uploading content, or any other use (“Use”) through any means or device.

• “Services” provided by the Site — browsing the Site and viewing contents designated for viewing by the Site Owners, uploading content, as well as possible future online trade on the Site.

For the purposes of these Terms, “uploading to the Site”, “posting on the Site”, and “publishing on the Site” are regarded equally; the provisions applying to one apply to the others also.

Any User is welcome to Use the Site, as long as they accept the conditions of these Terms (if You are under 18, please note the special conditions that apply to You, further down in these Terms of Use).

However, the Site Owners reserve the right to suspend or deny a User’s access to some or all of the Services on the Site (by all means at their disposal), for a limited or unlimited period, at their sole discretion and for any reason. Although We will generally exercise this right (as stated, at Our discretion) only in special cases — for example, in cases where there is a concern You have violated the provisions of these Terms (or any other terms of the Site), or the provisions of the law, or in the event that You harm or attempt to harm the proper operation of the Site or any third party, We will be entitled to do so to the extent that We deem, according to Our sole discretion, that it is right to do so, and We will not be obliged to explain or justify Our decision on the matter.

A User of the Site whose access has been suspended or denied as stated may not attempt to bypass his/her restriction from Using the Site by any means during the restriction period.

You may make any Use of the Site that complies with the provisions of these Terms and the provisions of the law, as long as the Use is personal and private. The Site and its Contents (as defined below) are not intended for Your commercial use, or any other non-personal use, unless otherwise expressly stated. To the extent that You wish to make any other use of the Site, including (but not limited to) placing advertisements, please contact the Site Owners via the Contact page on the Site. The Site Owners, as well as those who have received express permission from them, and they alone, are permitted to place advertisements and commercial information on the Site.

Use of the Site is permitted for all ages. However, Use of the Site by minors is subject to the approval and supervision of their parents or legal guardian.

If You are under the age of 18, please ask Your parents or legal guardian for permission before Using the Site. When You Use the Site, You are essentially declaring to Us that You have received permission from them – after they have carefully read these Terms of Use and confirmed that they supervise all of Your activities on the Site and are personally responsible for them, and that they have explained to You the meaning of these Terms and their provisions.

The Site and all its Content (as the term is defined below) is protected by Copyright laws of the State of Israel, international treaties and copyright laws of other countries.

All rights, including intellectual property rights in the Site and Services, belong to the Site Owners, or to third parties who have granted the Site Owners permission to use them within the framework of the Site and Services.

Without derogating from the foregoing, the Domain, the Site’s databases, names and trademarks, patents and logos, whether registered or unregistered, the trade secrets involved in operating the Site and providing the Services, the Site’s design, the technological information involved in operating it, including (but not limited to), software, applications, graphic and other files, computer codes, texts, images, video, audio content and/or any other material contained therein (excluding User Content, as the term is defined below) — hereinafter referred to as the “Site Contents”, are the sole property of the Site Owners and/or of a third party that has given the Site Owners permission to use them, and the use of all the rights aforementioned is permitted to the Site Owners and/or to third parties, provided they own the right and license to do so. The Site Contents and/or any part thereof may not be copied, distributed, reproduced, created derivative works, displayed publicly, made available to the public, provided to a third party, modified, published, broadcast, transferred, sold, distributed, or used commercially in any way, except with the prior written permission of the Site Owners.

“User Content” or “Content that a User uploads to the Site” — any content that a User has uploaded and/or will upload to the Site, whether through the Site’s “Contact” page or through Facebook’s comments service, or any other means, including (but not limited to) words, images, video, audio, advertisements, business ratings and opinions, or any other material and the like.

You may upload any Content to the Site — including through Facebook’s comments service, provided that it meets the conditions set forth in these Terms. Below in these Terms, We will list various types of content and statements that You may not upload to the Site. The aforementioned list is not a closed list and content and statements that the Site Owners deem should be prevented from being uploaded to the Site will be added to it from time to time. This list should be considered to also include content and statements that are prohibited by any law, even if not explicitly stated in these Terms of Use. Remember that You are not permitted to upload to the Site any content that does not meet the requirements of the law and/or these Terms and/or violates the rights of any third party.

The Site owners have the right to delete Your Content from the Site or deny Your access to it as stated. Your responsibility for the Content You upload to the Site will apply whether or not the Site Owners have exercised their right.

When You upload Your Content to the Site, You declare that You own all relevant rights to them for the purpose of complying with the provisions of these Terms, and that You do not violate any law or harm a third party by uploading them.

When You upload feedback to the Site, such as, without limitation, suggestions for improving the Site’s appearance and efficiency, professional opinions, or ratings of products advertised on the Site, You agree to grant the Site Owners a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right and license to use, reproduce, disclose, sublicense, distribute, modify, and exploit such feedback without restriction.

If You violate rights or law of any kind or violate any provision in these Terms, You are beautifying the power of the Site Owners to remove any responsibility from themselves and to transfer any claim on the matter to You.

You undertake to compensate and indemnify the Site Owners for any damage, loss, or expense, of any kind and type (including legal expenses), incurred or to be incurred by the Site Owners, related (directly or indirectly) to the Content You uploaded to the Site and/or any action or Use You made on the Site and/or in connection with Your violation of the provisions of these Terms of Use or any other terms to which the Use of the Site is subject, or the provisions of the law, or injury to any third party; and this immediately after the first demand of the Site Owners, and this in addition to any right available to the Site Owners under any law.

Deletion of User Content:

The Site Owners may (but are not required to) remove content uploaded to the Site at their sole discretion. The Site Owners shall not be required to notify You prior to removing Your Content and shall not be required to provide an explanation for the reason for removing Your Content.

Without derogating from the aforementioned, if information about Content uploaded to the Site by a User, and which constitutes a violation of any law, harms a third party in any way or violates a provision of these Terms, is brought to Our attention, the Site Owners will be entitled to remove the Content or block it for viewing, at their sole discretion.

Remember that Your Use of the Site, including all its Services, is provided “AS IS” and “AS AVAILABLE”, and is Your sole responsibility.

When You Use the Site, You waive any claim, allegation, and demand against the Site Owners, their suppliers, or anyone on their behalf.

In particular, You completely and irrevocably exempt and release the Site Owners from any liability for any damage (direct or indirect), loss (including loss of profit), or expense of any kind, punitive damages, damages for loss of Use, or loss of data (“Compensation”), incurred or to be incurred by You or a third party and related, directly or indirectly, to User Content uploaded or appearing on the Site (including Content that You uploaded to the site), or to the Services on the Site. You also release the Site Owners from liability for any Compensation for delay in Using or inability to Use the Site or for the provision of Services, or for any information, software, product, service and related graphics obtained through the Site or otherwise arising from the Use of the Site. All this, whether based on an agreement or in tort, whether under strict liability or on any other grounds, even if the Site Owners were made aware of the possibility of any damage that might be caused.

The lack of responsibility of the Site Owners will apply even if they exercised and/or could have exercised any supervision and even in a situation where they were aware of the possibility of any damage, which may be caused to the User or any third party, in all matters related to and concerning the Site, its Use, the inability to Use it, the cancellation of the Services, their limitation, or termination.

The lack of liability of the Site Owners will apply even if the Site Owners attempted, out of goodwill and beyond the letter of the law, to help resolve a problem or respond to a User’s request. Such assistance shall in no way be construed as imposing any liability on the Site Owners.

The Site Owners do not guarantee the correctness of the information posted on the Site (among other things, concerning any Content, advertisement, Services, products, links to other websites, opinions, and positions) and its Use and reliance on it are Your sole responsibility.

The Site Owners reserve the right to delete an advertisement at their sole discretion, if it is found to be offensive (without this imposing any liability on them) or for any other reason, without the Site Owners being required to provide an explanation or justification.

The Site Owners’ lack of liability for links to other websites or to websites hosted on the Site’s domain name:

• The Site Owners do not guarantee that all links found on the Site will be correct and will lead to an active website.

• The mere presence of a particular link on the Site to another website or the presence of any website hosted on the Site’s domain name does not indicate that the content of the linked website and/or the linked or hosted website itself does not violate any rights and/or obligations, is reliable, complete or up-to-date, and the Site Owners will not bear any liability in this regard. Furthermore, the Site Owners do not control, supervise, or are not responsible in any way for the activities and privacy policies of any third party, including other websites to which links exist on the site, whether textual or visual links (i.e., links that allow direct access from the Site to other content), sites hosted on the Site’s domain name, or any other content displayed on the Site by a third party, such as an i-frame or embed. The Site Owners urge Users to review the terms of use and privacy policies of these websites before using them and before providing personal information on these websites.

• You may find that these websites do not suit Your needs, or that You object to their content, or that You believe they are outrageous, offensive, inappropriate, illegal, or immoral: the Site Owners are not responsible for the content, data, or visual elements to which the links from the Site lead and are not liable for any consequences that may arise from their use or reliance on them. The mere placing of a link on the Site to another website does not constitute support, encouragement, agreement, or sponsorship by the Site Owners of the content or services offered on that website.

Lack of liability of the Site Owners for the Services:

• The Site Owners are not responsible for the availability of the Services on the Site, and do not guarantee that the Services will not be disrupted, will be provided as scheduled and without interruptions, will be held safely and without errors, and will be immune from unauthorized access to the Site Owners’ computers or from damage, breakdowns, malfunctions, or failures in the hardware, software, communication lines and systems, of the Site Owners or any of their suppliers.

• In addition, the provision of Services by the Site Owners depends, among other things, on third parties, and the Site Owners are not responsible for any act or omission of third parties and will not be liable for any damage, loss, or expense caused to the User or any third party as a result of or in connection with any such act or omission.

Lack of liability of the Site Owners regarding User Content:

• The User is solely responsible for the User Content he/she uploads to the site.

• The Site Owners are not responsible for the content, form, authenticity, reliability, and accuracy of User Content, and as part of this, they are not liable for any infringement or violation of third-party rights or violation of the law in connection with User Content or in connection with any use of the Site by Users.

• The Site Owners are not liable for the reactions that the User Content may provoke or for the use that others may make of the User Content (for example, infringement of intellectual property rights). Please keep this in mind, among other things, when You upload content that may harm or provoke any other person.

Browsing the Site and Using the Services included in it constitutes consent on Your part that the Site Owners and/or third parties will supervise and computer monitor Your browsing patterns and the Use You make of the Site, among other things through the placement and reading of cookies (cookies are small files placed on Your computer, mobile device, or any other device by a website, the purpose of which is, among other things, to help collect information about the viewing and use of that website, and to tailor the advertisements or content that will be presented to You to topics that interest You.)

The Site Owners use third parties for the purpose of activating certain services, such as, among others, contact forms.

The Site Owners may use third parties, including advertising companies, to display advertisements on the Site and/or provide other services. Some of the advertisements and/or services may come from third-party servers. It is possible that these parties will collect data about Your activity. It is also possible that these parties will use data (which does not include Personal Data, as defined below) about Your online activity, among other things, in order to provide advertisements for products and services that may be of interest to You. All of which being subject to a privacy policy that may differ from the Privacy Policy of the Site Owners and that would be detailed on the websites of those third parties.

You can delete cookies or choose to avoid receiving cookies by changing the settings in Your browser. Remember that disabling cookies may mean that You will not be able to use some of the Services and features on the Site or other websites and that We will not be able to tailor advertisements and content to You.

It is possible that You have provided or will provide Personal Data by way of uploading messages, including in the messages You send to the Site Owners (via the Contact page on the Site). With respect to this Personal Data, there is no legal obligation to provide it, and You provide it at Your own initiative and will.

“Personal Data” means any identifying information, including name, telephone number, residential address, e-mail address, and any other information of an identifying nature.

The Personal Data as well as the anonymous data will be stored in a database and the data will be used only in accordance with these Terms of Use and/or in accordance with the provisions of any law — including for the purposes listed below: 

• To provide You with the information, Services, and details You have requested.

• To send You from time to time by e-mail (according to the address You provided), links, messages, advertisements, material, information including advertising or marketing, and any other information that We believe You will find interesting by virtue of Using the Site and/or any of its Services. If You do not wish to continue to receive this type of information via e-mail, You may revoke Your consent and cease receiving commercial information.

• For control, supervision, development, and maintenance of the quality of the Services, their level and integrity, and for the purpose of complying with the provisions of any law.

• For the needs of the Site Owners, including surveys, segmented advertising, statistical analysis and improving the Service, and design of the Site.

You hereby give Your consent to the Site Owners to disclose and/or transfer Your details and any information, including the Personal Data regarding You, in accordance with the provisions of a court order or any other authorized body, or within the framework of proceedings if they arise between You and the Site Owners, or in the event that You violate a provision set forth in these Terms of Use, or in the event that the Site Owners, at their sole discretion, deem it necessary to prevent serious damage to Your body or property, or the Site Owners’ or anyone else’s, or in the event of a merger of the Site’s activity (in whole or in part) with any third party and/or the transfer of the Site’s activity (in whole or in part) to a third party, and/or to an entity to which the Site Owners assign the rights granted to them by virtue of these Terms of Use (in whole or in part) and/or to a third party that provides them with services regarding the Site and/or any of the Services contained therein.

When Using the Site, please Use it in accordance with the provisions of the Terms of Use and of the law. Please avoid harming other Users or even third parties who are not expected to Use the Site.

Without derogating from any other provision in these Terms of Use, You declare and undertake to Us as follows: (The following sections do not derogate from each other) 

• Not to upload any commercial advertising, sponsorship, sales promotion, election propaganda, polls or contests, except in places expressly designated for this, as far as they exist and subject to the other provisions of these Terms and the instructions of the Site Owners.

• Not to upload content that contains sedition or incitement.

• Not to upload any content that discloses a detail that may reveal the identity of a minor, except for his/her first name and/or nickname, such as: the school he/she attends, his/her address, his/her last name, his/her e-mail address, and any means of contacting him/her.

• Not to upload content that contains defamation.

• Not to upload content of a racist nature or content that may incite racism.

• Not to upload content that there is in its uploading or in its publication grounds for a lawsuit, or content that could cause damage to any third party or to the Site Owners.

• Not to upload any content that there is in its uploading or in its publication (in accordance with the conditions set forth in these Terms), infringement of the intellectual property of a third party, including copyrights, performance rights, trademarks, trade names, designs, patents, etc. Not to upload any content that there is in its uploading or in its publication infringement of the rights of a third party, including disclosure of trade secrets, breach of contractual rights, breach of fiduciary duties, commercial wrongs, etc.

• Not to upload content that is blatant, obscene, vulgar, or inappropriate.

• Not to upload content of a sexual nature.

• Not to upload content that constitutes a violation to the individual’s right to privacy.

• Not to delete the copyright or other proprietary rights notice from any content of the Site.

• Not to copy from the Site contents posted on it, including Users Contents; and without derogating from any other provision in these Terms, not to use Contents posted on the Site for any purpose other than the use for which they were intended.

• Not to systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from Us.

• Not to circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the Use or copying of any Content, or that enforce restrictions on the Use of the Site.

• Not to engage in framing or mirroring of the Site without the written consent of the Site Owners.

• Not to upload any content that is or its publication is illegal or constitutes (or may constitute) a violation of any law (including under a gag order) or material that encourages, supports, assists, provides instructions for, or guides the performance of an act that constitutes a criminal offense under the laws of the State of Israel.

• Not to bother or harass other Users or the Site Owners or threaten them.

• Not to interfere or attempt to interfere with the proper operation of the Site and its Services.

• Not to post Personal Data of other Users.

• Not to collect data on other Users.

• Not to impersonate another person, another User, or anyone on behalf of the Site Owners.

• Not to trick, defraud, or mislead Us and other Users, especially in any attempt to learn sensitive information such as User Personal Data.

• Not to Use any information obtained from the Site in order to harass, abuse, or harm any third party.

• Not to flood the Site, or any part, or Service thereof, with idle messages or repeated messages, in a way that could damage the Site or its Use.

• Not to make improper use of the Contact page or the Facebook comments service on the Site to harass, annoy, intimidate, or threaten Us, or submit false reports of abuse or misconduct.

• Not to Use the Site’s Services for the purpose of committing an act or action prohibited by any law.

• Not to engage in any automated use of the system, such as using scripts to send responses or messages, or using data mining tools, bots, or similar tools to collect and extract data.

• Not to upload or transmit any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (GIFs), web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms”).

• Not to illegally access computer material or files or transmit to other computers (including the computers of the Site Owners) computer software, computer code, or applications that contain a computer virus, including hostile software known as Trojan horses, worms, vandals, malicious applications, etc., and not to perform any other action that violates the provisions of any law.

• Not to provide any link or other reference to material whose publication is prohibited under these Terms of Use.

• Not to Use the Site as part of any effort to compete with Us or otherwise Use the Site and/or its Content for any revenue-generating endeavor or commercial enterprise.

• Not to Use the Site to advertise or offer to sell goods and services without the written consent of the Site Owners.

The laws of the State of Israel shall govern these Terms and this Site and all that arises from or is involved in it, and they shall be interpreted in accordance with these laws. Your Use of the Site may also be subject to other local, state, national, or international laws.

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Sites Owners.

Translation Interpretation:

These Terms of Use may have been translated if We have made their translations available to You through the Site. You agree that the original English text shall prevail in the case of a dispute.
